1. Definitions

"Rider" means a person or individual who offers its delivery services through the BagyesRUSH APP Service. "Order Agreement" means an agreement for the purchase of Rider's services made on an Order. "BagyesRUSH" means: BagyesRUSH Delivery (Community 16, Tema-Ghana). "BagyesRUSH APP(Both RIDER/USER)" means a mobile application called BagyesRUSH APP provided by BagyesRUSH Delivery for legal persons with the right documentation and approval of the Ghanaian government, having gone through the right processes to receive domestic delivery orders and render delivery services on. "BagyesRUSH" means BagyesRUSH Delivery, BagyesRUSH APP (Both Rider/User) and BagyesRUSH Delivery website (www.bagyesrushdelivery.com). "User" or "you" means a natural person using the BagyesRUSH APP. The User must be of the age of 18 or older. "Rider" means a natural person who owns his or her motorcycle with DVLA valid License and using the BagyesRUSH Rider App for delivery services requested by customers/user. The 'Rider' must be of the age of 21 or older.

2. Identity of BagyesRUSH APP

BagyesRUSH Delivery (licensed by the Postal and Courier Services Regulatory Commission), sole proprietor incorporated in Ghana with business registration number BN080822017 having its office at Community 16, TEMA. Email address : bagyesrush@gmail.com

3. Description of the BagyesRUSH APP Service and USE

3.0. BagyesRUSH APP gives USERS access to do multiple deliveries to different drop-off locations and a USER can also PICK up an ITEM from a different pick up location to his or her destination or a customers location.

3.1. BagyesRUSH APP provides a platform on which the User can request for a delivery services with as little as the client's pickup location/phone number and drop-off location/phone number and Payment.

3.2. The Rider provides the information about their location, phone number and availability to complete a delivery in the BagyesRUSH APP Service. Users can also contact BagyesRUSH Delivery customer support who can contact the Rider on their behalf for any enquiries. The Rider is however responsible for providing accurate contact details, up-to-date personal documents and legally required documents about the vehicle to be used in BagyesRUSH APP services. Please note deliveries may be subject to additional terms and conditions of BagyesRUSH Delivery on a case-by-case basis as set out in the BagyesRUSH APP Service.

3.3. When confirming an order, the User makes a binding order to purchase services from the Rider on the terms and conditions presented to the User herein and in the BagyesRUSH APP before placing ("the Order"). After having received the Order, BagyesRUSH APP will transmit the details of the Order to the Rider. When the Order is accepted by the Rider and BagyesRUSH APP has provided the User with an order confirmation on behalf of the Rider, the User/Customer and the Rider enter into the Order Agreement for the purchase of the Rider's services and, if applicable other services which payment can be made by using only your balance in your BagyesRUSH APP user Wallet by adding funds from your Momo wallet.

3.4. The Rider that accepts the User's order will pick up and set out on the Order. BagyesRUSH Delivery is not responsible or liable towards the User for deliveries made offline such as but not limited to contacting the rider directly. BagyesRUSH Delivery is only liable for the execution of the delivery services that strictly adhere completely to our Terms of Service.

3.5. BagyesRUSH Delivery is not responsible or liable towards the User for any delivery of an item over GHS200, BagyesRUSH Delivery is not responsible or liable for any other services requested by the User to be completed by the Rider aside "BagyesRUSH APP Services".

3.6. BagyesRUSH Delivery is not responsible or liable towards the User for any money given to the Rider beside the delivery fee.

3.7. Customers are always advice to use BagyesRUSH APP to request for delivery services each time.

3.8. Notice to all users, 'BagyesRUSH' APP is a cashless system. Fund your BagyesWallet by depositing money from your Network Momo account and be using that to pay for all your delivery fees through the APP.

4. Right of revocation

Users can withdraw from or cancel an order anytime. Riders cannot cancel or withdraw from any order unless its prior to picking up the order. In any case where either Rider or User may want to cancel both parties will have to be well informed and come to an agreement. BagyesRUSH Delivery is not responsible or liable towards the User or/and the Rider for and not limited to any damages as a result of order cancellation.

5. User Accounts

5.1. You have a limited, non-exclusive, non-transferable, and non-sub licensable right to use the BagyesRUSH APP in the form offered to you by us from time to time solely for the purposes set out herein. The license granted to the User for both iOS and Google Play store 'BagyesRUSH APP' downloadable is further limited to use the BagyesRUSH APP on any Apple-branded or Android products that the User owns or controls and as permitted by the Usage Rules set forth in both App Stores Terms of Service and BagyesRUSH APP Terms of USE/Service.

5.2. In order to use the BagyesRUSH APP, the User must create a user account by following the registration instructions on the BagyesRUSH APP. The BagyesRUSH APP credentials are personal (unless otherwise agreed between BagyesRUSH and the User. The User shall ensure that user account credentials / information required to access their account are kept confidential and used in a secure manner not accessible by third parties apps. A User may have only one personal user account.

5.3. Where it is suspected that any unauthorized person has become aware of a User's user account credentials or has access to the user account of the User, the User shall immediately inform BagyesRUSH Delivery to suspend or reset user's account if not the User shall be responsible for any use of the BagyesRUSH APP and any activity under the user account of the User.

The information contained on the Service is for general information purposes only. The Company(BagyesRUSH Delivery) assumes no responsibility for errors or omissions in the contents of the Service.

In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice.

The Company does not warrant that the Service is free of viruses or other harmful components.
